International patent application

An international patent application can be filed in the form of an application in accordance with the „Treaty on the International Cooperation in the Field of Intellectual Property“ (Patent Cooperation Treaty = PCT). This application does not result in a patent, but rather forms the central starting point for individual national procedures. However, a search is performed and a first preliminary assessment of patentability is issued. Only after expiry of 30 months, respectively 31 months after the priority date has a decision to be taken on the countries in which the international patent application will be proceeded with as a national, respectively regional patent application.
